大家都知道，用LOTR 同BN(O) Visa 人士嚟嘅小朋友可以免費讀state schools，不過讀大學條數，大家其實又計清楚未呢？🙄

有關Home Fee vs Overseas Fee，其實我哋之前都出post 提及過，不過最近同大家傾開，發現好多家長都唔係好理解，或者諗住「到時先算」，在此我哋要提醒下，條數真係不容忽視，畢竟Overseas Fee 就算係文科都要每年超過21萬港紙架 (理科就更貴了)😓😓（Home Fee 就係around 10 萬）！ 此外，一旦入學時係Ooverseas 身份，就算喺就讀期間居英身份有變，除非大學特別批准，否則仍然需要喺整個課程期間繼續交Overseas 學費架！ 😵
首先，最最最簡單總結一下：
小朋友喺Year 8 9 月開學之前嚟嘅，理應穩陣，入大學之時可以繳交Home Fee；👏
Year 9 嚟? 有機會可以交Home Fee，亦有可能要take 1 年gap year 之後先得，要睇當局進一步公佈嘅政策；🙏
Year 10 或之後先嚟? 正常情況下要交Overseas Fee，除非take 1 年gap year (甚至兩年，等當局宣布）。😯
當然，現時英國政府其實未講實呢方面嘅情況，不過以上係我哋睇完當刻available 嘅相關條文之了解。🧐
根據Hong Kong British National (Overseas) Visa policy statement, BN (O) Visa 持有人嘅status是咁的：
"The visa will be valid for up to 5 years, during which time the holder is subject to UK immigration control. After 5 years in the UK and, provided they have stayed free of criminality, have supported themselves financially and otherwise complied with the terms of the visa, they will be able to apply for settled status; after a further year they may apply to naturalise as a British citizen"
另一方面，UK Council for international student affairs 就住"Home Fee" 同 "Overseas Fee" 嘅準則是咁的 （適用於香港人主要係Situation 1 ）：
"1. Those who are 'settled' in the UK and meet the main residence requirements 😼
In order to qualify for 'home' fees under this category, you must meet all of the following criteria:
(a) you must be settled in the UK on the first day of the first academic year of the course; and
(b) you must be ordinarily resident in the UK on the first day of the first academic year of the course; and
(c) you must also have been ordinarily resident in the UK and Islands for the full three year period before the first day of the first academic year of the course, for example, if your course begins in October 2018 you must have been ordinarily resident in the UK and Islands from 1 September 2015 to 31 August 2018; and
(d) the main purpose for your residence in the UK and Islands must not have been to receive full-time education during any part of that three-year period.
Note: It is not necessary to have had settled immigration status in the UK for the full three years. You only need to show that you have it on, at the latest, the first day of the first academic year of the course."
綜合以上條文，我哋嘅理解係，持有BN(O) Visa 人士嘅子女最快要經過5年先有資格申請settled status👍，至於佢哋喺呢個time point 會否被詮釋為"settled in the UK"，符合相關要求可以繳交Home Fee，還是當局會stick with 條文本身，鑑於條文寫嘅係"must be settled in the UK" ，所以要再加1年，即係一共6年，就真係要留待當局再確認。🙏🙏🙏
簡單嚟講，除非再有進一步放寬，按照現時形勢，你哋嘅小朋友 落腳後要有5－6年時間先可以用Home Fee 入大學。🧐
有啲家長問： 我聽講3年就夠啦，唔係咩？🤔🤔🤔
呢個誤解，相信係源於：
- 佢哋搞亂咗持有BC 人士仔女嘅case; 😅 或者
- 佢哋睇到以上有寫 "ordinarily resident in the UK and Islands for the full three year period before the first day of the first academic year " 呢個條件，不過忽略咗呢個只係其中一個條件，畢竟條文用嘅字眼係"and" 而唔係 "or" ！ 🤨🤨🤨

如果真係想交Home Fee，其中一個辦法係take gap year，不過正如上面所講，Year 10 先嚟嘅有幾會係要take 2 年gap years ，大家真係要有心理準備。🤨🤨
